Here’s How to Comply with CA Sexual Harassment Training

As you know by now, as a result of SB 1343 the State of California will now require that all employers with more than 5 employees to provide Sexual Harassment Prevention Training by video or live in person at least 2 hours of training to all supervisory employees and at least one hour to all non-supervisory employees by January 1, 2020, and once every 2 years thereafter.

So, don’t panic! You have an entire year to get this done, however it would be best to process your existing employees as quickly as is possible, and then make sure you have a plan for all new employees and supervisors so that the training occurs sometime before a six month period beyond their hire or promotion date. Best to process this at hire as that will eliminate the need to pull an employee from their more productive activities after they are hired.

Keep in mind, Sexual Harassment Prevention Training before January 1, 2019 will not satisfy this new law, so don’t jump ahead in 2018 to get this done as you’ll just have to go through it again in 2019.

The State has included in the law’s text that the Department of Fair Employment and Housing will be required to provide the online training for both employees and supervisors. The online course must be interactive and thus will include periodic pauses with questions for the participant. We all know how government projects seem to work out so no telling how simple or efficient this process will be.

Additionally, a government pamphlet or comparable policy must be given to all employees and supervisors.

The policy must include:

  1. The illegality of sexual harassment.
  2. The definition of sexual harassment under applicable state and federal law.
  3. A description of sexual harassment, utilizing examples.
  4. The internal complaint process of the employer available to the employee.
  5. The legal remedies and complaint process available through the department.
  6. Directions on how to contact the department.
  7. The protection against retaliation
  8. A link to the State online training courses
